TERMS AND CONDITIONS

 

New Hampshire Retirement System (NHRS) and its third party vendors are providing an electronic payment site.  These terms and conditions are designed to provide you with information on the online electronic payment system as well as outline the important terms and conditions that apply to the use of this free service.  You and any person you authorize to perform functions on your account, agree to these terms and conditions when you access and use the service.

 

Note: This service is to be used only for submission of monthly member and employer contributions due to NHRS from its participating employers. This service should not be used for any other purpose.

 

1. Services Offered.  NHRS is offering this service to its participating employers to make electronic ACH payments for monthly contribution reporting. NHRS will assume the cost of any transaction fees associated with use of this service. There are two methods by which you are allowed to make payments:

a. The ‘Pay Now’ method allows one-time payments to be made to NHRS. The payee will need to first input their NHRS Employer ID number, and then the Employer’s Name, phone number, and contact email address. After that, the payee will input the payment amount (which should match the total amount on the associated voucher already sent to NHRS) and a payment description (for example – July 2019 pmt), and then add a payment method with all of the bank account information. Using this method will allow for a payment to be made a single time, with no payment information being stored on the site. This method can be used every time the payee uses this service to make a payment.� 

 

b. The ‘Login’ method requires payees to create an account which will allow employer and bank information to be stored, thereby making the monthly payment process easier. To set up such an account, the payee first must make a payment using the ‘Pay Now’ method. At the conclusion of that payment, the payee will be given the option to click a link to Enroll with your Current Information which will then prompt the payee to confirm the employer and banking information and then complete some security questions in order to establish the account.

2. Passwords for Login.�  The Password must be used each time you access our service.  You agree not to disclose or otherwise make your Password available to anyone not authorized to sign in to your account(s).  You are responsible for maintaining the confidentiality and security of your Password. Passwords must be a minimum of 8 characters and must contain at least 3 of the following:

i. 1 or more digits

ii. 1 or more uppercase letters

iii. 1 or more lowercase letters

 

3. Erroneous Instructions.  If we receive a payment instruction authorized by you and the instruction is erroneous in any way, we shall have no obligation to detect the error or have any liability for the error. We will take reasonable steps to work with you and your financial institution to correct and mitigate the impact of any such error.

 

4. Transaction Limitations.  Please be aware that certain types of bank accounts have limits on the numbers of transfers or withdrawals that may be made per month.  For example, some banks may have a limit of only six transfers and/or withdrawals per month from a savings or money market deposit account by preauthorized or automatic transfer.  Your bank may refuse transfers that exceed such limits, so we recommend you check with your bank to determine what limitations, if any, are imposed on withdrawals from any account.  If we are not able to debit the amount required to cover an authorized payment from your account, we will not be able to make the contribution you have authorized, and will not be held liable for any interest charges, penalties, costs, damages, etc., caused by the failure to make the payment.  We have no obligation to try to debit an account for a specific payment more than once.

5. Authorized Users.  If there are other authorized users on your account(s), you hereby authorize each of them to use your Password(s) and this service.  Any signer on such accounts is authorized to make payments, even if your account otherwise requires two or more signatures for withdrawals.

6. Business Days.  Our business days are Monday through Friday, excluding legal holidays.

7. Electronic Disclosures.  We may be required to occasionally provide you with certain disclosures and notices, which are mandated by various laws and rules.  You agree to receive all such disclosures electronically, which in most cases will be communicated by an email advice to check NHRS online bill payment web site for a copy of the notice.

8. Confidentiality.  We will never sell or otherwise disclose your personally identifiable information to a third party.  We will only disclose information to third parties about your account or the transfers or payments you make:

� 

a. Where it is necessary for opening or maintaining your account, or for completing transfers or payments;

b. If lawfully required; or

c. If you request or authorize it.

� 

9. Your Liability.  You agree to regularly and promptly review and verify all transactions through the monthly statements received from your bank holding the account(s).  Tell us AT ONCE if you believe your Password for Login has been lost or stolen.  Also, if your bank statement shows transactions by us that you did not authorize, you agree to contact your bank immediately.

10. Limitation of Liability.    You agree that neither NHRS nor any third party vendor involved in creating or delivering this service shall be liable for any direct, indirect, incidental, consequential or punitive damages arising out of your access to, or use of this web site.  We assume no responsibility for and will not be liable for any damages to or any viruses, which may affect your computer equipment or other property on account of your access to, use of or downloading from our web site.

11. In Case of Errors or Questions About Transfers From Your Account.  ALL QUESTIONS ABOUT TRANSACTIONS MADE WITH YOUR PASSWORD MUST BE DIRECTED TO YOUR BANK.

12. Change In Terms.  It is possible that our terms and conditions may change over time.  We will post any changes on this web site and will send you any legally required notice.  Prior notice may not be given, however, where an immediate change is necessary for security purposes.

13. Termination.  We reserve the right to terminate your service at any time with or without cause.  We may immediately terminate your use of the service if:

� 

a. You or any authorized user of your Password breach any agreement with us;

b. We have reason to believe there has been or may be an unauthorized use of your Password, your accounts, or our service;

c. Any party associated with your accounts or your service requests that we do so; or

d. There are conflicting claims to the funds in your accounts.

 

Please note that if you or another party asks us to terminate your service, or your accounts are closed for any reason, you will remain liable for transactions previously authorized.

14. Waiver.  If we fail to enforce any of our rights under these terms and conditions, our Privacy Policy (which can be found at https://www.nhrs.org/privacy-policy/) or applicable laws, it shall not be deemed to constitute a waiver of such right.  If any provision of these documents is found by a court to be invalid, then the remaining terms and conditions shall remain in full force and effect.

 

15. Agreement by Use of Service.  By accessing and using this site, you agree to the terms and conditions of these Terms and Conditions without limitation or qualification.

16. Amendment.�  We reserve the right to amend these Terms and Conditions from time to time.  Your continued use of the service after notice of our Amendment will constitute acceptance of the Amendment.
